The paperwork for letting your flat, without surprises
Energy certificate, occupancy certificate depending on your region, contract and deposit registration: the papers to have ready before the first listing.
Letting a property properly requires only a few documents, but it is worth having them before you publish the listing: some take days and one is compulsory even to advertise.
Energy performance certificate
Compulsory to advertise and to let. It is issued by an accredited technician after visiting the property and registered with your regional authority. If you do not have one, request it in advance: several days can pass between the visit and the registration.
Occupancy certificate (depending on your region)
In some Spanish regions it is compulsory to let (and to connect utilities); in others it does not exist as such. Check what yours requires and whether the one you have is still valid — they expire.
The contract, in writing
The law allows verbal agreements, but a tenancy without a written contract is a source of problems for both sides. The contract should set out the identity of the parties, a description of the property, the rent, the term, the deposit and the agreements on costs (building fees, property tax, utilities).
Registering the deposit
A one-month deposit does not stay in your drawer: in most Spanish regions you are required to lodge it with the relevant regional body, within the deadline your region sets. Keep the receipt — you will be asked for it when returning the deposit.
And for your own peace of mind
- A signed inventory with photos if you let it furnished.
- The latest boiler or gas installation check, if there is one.
- Declare the rental income on your tax return: beyond being compulsory, letting a primary residence attracts tax reductions.
